Welcome to Wazen, a WhatsApp API platform operated by IrixSoft ("Company", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our website, applications, and services (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.
2. Service Description
Wazen provides a REST API platform that enables developers to programmatically send and receive WhatsApp messages. Our Service includes:
- WhatsApp messaging API for text, images, videos, audio, and documents
- Real-time webhook notifications for message events
- Session management for WhatsApp connections
- Number warming module to protect new accounts
- Dashboard for account and session management
3. Account Registration
To use the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain the security of your password and API keys
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this requirement.
4. User Obligations
When using the Service, you agree to:
- Comply with all applicable laws and regulations
- Comply with WhatsApp's Terms of Service and policies
- Only send messages to recipients who have consented to receive them

5. Acceptable Use

6. Subscription and Payments
The Service offers both free and paid subscription tiers:
- Free Tier: Limited features with restrictions on messages and sessions
- Paid Tier: Full access with higher limits, billed as a pre-paid subscription
Paid subscriptions are non-refundable. When your subscription expires, your account will be downgraded to the free tier until you renew.
7. Service Limitations
The Service is provided subject to the following limitations:
- We do not guarantee 100% uptime or message delivery
- WhatsApp may disconnect sessions at their discretion
- Rate limits and usage quotas apply based on your subscription tier
- Message retention is limited and varies by subscription tier
- We reserve the right to modify features and pricing with notice
8. Intellectual Property
The Service and its original content, features, and functionality are owned by IrixSoft and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our written permission.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
10. Limitation of Liability
IN NO EVENT SHALL IRIXSOFT, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE.
11. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will cease immediately. All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
12. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration.
13. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.
