Terms of Service

1. Acceptance of Terms

By accessing and using WAZEN (the "Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

WAZEN provides a WhatsApp API service that allows developers to send and receive messages, manage groups, handle contacts, and automate WhatsApp interactions through a RESTful API. The Service is provided by IrixSoft.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Provide accurate and complete registration information
  • Keep your account credentials secure
  • Immediately notify us of any unauthorized use of your account
  • Not share your account with others or allow others to access your account

4. Acceptable Use

You agree not to use the Service to:

  • Send spam, unsolicited messages, or promotional content without consent
  • Violate any applicable laws, regulations, or third-party rights
  • Distribute malware, viruses, or harmful code
  • Harass, abuse, or harm other users
  • Impersonate any person or entity
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to the Service
  • Violate WhatsApp's Terms of Service or policies

5. Rate Limits and Restrictions

Your use of the Service is subject to rate limits based on your subscription tier:

  • Free Tier: 5 conversations/month, 50 messages/day, 5 API requests/minute
  • Paid Tier: Unlimited conversations, 2000 messages/day, 60 API requests/minute

We reserve the right to modify these limits at any time with reasonable notice.

6. Payment and Billing

For paid subscriptions:

  • Fees are charged in advance for the selected billing period (monthly, 3-month, 6-month, or 12-month)
  • All fees are non-refundable unless required by law
  • We reserve the right to change pricing with 30 days notice
  • Failed payments may result in service suspension
  • You are responsible for all applicable taxes

7. Data and Privacy

Your use of the Service is subject to our Privacy Policy. We encrypt all message data and offer configurable retention periods (7, 14, or 30 days). You are responsible for complying with all applicable data protection laws when using the Service.

8. Service Availability

We strive to provide reliable service but do not guarantee 100% uptime. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any damages resulting from service interruptions.

9. Intellectual Property

The Service and its original content, features, and functionality are owned by IrixSoft and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express permission.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. You may cancel your account at any time through the dashboard settings.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12. Limitation of Liability

IN NO EVENT SHALL IRIXSOFT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR SERVICE INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

13. Indemnification

You agree to indemnify and hold harmless IrixSoft from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another party.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which IrixSoft operates, without regard to its conflict of law provisions.
